Apple’s attempt to appeal its rejected early ban on certain Samsung products in the U.S. has been largely unsuccessful. Although Judge Lucy Koh, who oversaw the main case, found it possible that Samsung had imitated Apple technology, there was no sufficiently strong evidence that any copying on the part of the South Korean company was doing any harm to Apple’s business. The California device maker had tried to argue there was no need to prove it had lost customers, implying that the very instance of infringement should be enough to get the asserted devices banned.

On Friday, the ITC has turned down the first filing of a set of complaints lodged by HTC against Apple, ruling that the California device maker didn’t infringe on its power management patent. The Taiwanese firm has a right to appeal the decision, though it hasn’t made any announcement of such plans so far. If HTC opts not to appeal, the dismissal could put an end to its lawsuit versus Apple that was first filed in May of 2010 and has been eventually reduced to just one out five initially claimed patents.
