Apple has failed to persuade a Washington appeals court to reconsider a decision that previously prevented it from getting Samsung’s Galaxy Nexus banned in the U.S. The denial marks a rare defeat suffered by the company in its long-lasting legal combat against Android smartphone designers.

The handset in question was first mentioned in a patent lawsuit filed last February along with other Samsung products. The request for injunction was granted in June, and Judge Lucy Koh stood firm by her initial ruling, having dismissed Samsung’s request for a temporary stay on the ban.

Following Apple’s recent victory in a German court which upheld a sales ban against the Samsung Galaxy Tab 7.7 throughout the European Union, two other Samsung products, the Galaxy Nexus and Galaxy Tab 10.1N, were cleared of all infringement charges on Thursday. The latest ruling of the Higher Court of Munich is actually an appeal of the initial decision made by a lower court in February, IDG News Service claims. In an original complaint, Apple argued the two devices violated its European ‘scrolling’ patent.

On Wednesday, a Munich court turned down Apple’s motions to have preliminary injunction imposed on the Galaxy Tab 10.1N and Galaxy Nexus. Judge Andreas Mueller agreed with Samsung’s opinion that the 2011-era Apple patent at stake would be more likely revoked, leaving the South Korean electronics developer’s devices in the clear. Before Apple had sued Samsung in Germany, prior art already existed on the market, the court stated.
